This Privacy Policy explains how Smartstack Platforms LLC (“Smartstack,” “AI Mentor Studio,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with AI Mentor Studio.

This policy applies to mentorstudio.ai, related websites and subdomains, individual Studios, AI mentors, embedded mentor experiences, lead pages, sales pages, membership areas, creator tools, and other services that link to this policy collectively referred to as the “Platform.”

By using the Platform, you acknowledge the practices described in this Privacy Policy.

1. Our Role and the Role of Studio Creators

AI Mentor Studio is a multi-tenant platform. Individual creators and organizations can operate their own branded Studios through the Platform.

Smartstack collects and processes information needed to operate the overall Platform.

Studio Creators may separately determine what Mentors they create, what information their Mentors request, what lead or registration forms they publish, who may access their Studio, what products or memberships they offer, and how they use information they independently export or collect.

Depending on the situation, a Studio Creator may be independently responsible for its privacy practices.

A Studio may provide additional privacy notices or terms. Questions about a particular Studio’s content, offer, or independent use of information should be directed to that Studio Creator.

2. Information We Collect

The information we collect depends on how you interact with the Platform.

A. Account and Identity Information

We may collect:

  • Name;
  • Email address;
  • Account identifier;
  • Login and authentication information;
  • Profile image;
  • Studio memberships;
  • Account roles and permissions;
  • Invitation information;
  • Company or organization name;
  • Account preferences.

B. Creator and Studio Information

When you create or manage a Studio, we may collect:

  • Studio name and description;
  • Branding, logos, icons, and colors;
  • Studio domain or subdomain;
  • Mentor names, descriptions, instructions, and configurations;
  • Uploaded reference documents;
  • Lead-page and sales-page content;
  • Membership plans and access settings;
  • Co-Creator information;
  • Creator support and onboarding information;
  • Information about clients or Studios you manage.

C. Mentor Conversations and Submissions

When a person interacts with a Mentor, we may process:

  • Prompts and questions;
  • Responses and questionnaire answers;
  • Conversation history;
  • Uploaded documents or reference materials;
  • AI-generated responses;
  • Session status and progress;
  • Mentor completion information;
  • Message counts and usage information;
  • Feedback about the experience.

The specific information requested by a Mentor is determined in part by the Studio Creator who configured it.

Do not submit information that you do not have the right to provide.

D. Lead Forms, Registrations, and Membership Information

When you register for a Studio, join a plan, or complete a lead form, we may collect:

  • Name;
  • Email address;
  • Studio registration information;
  • Form responses;
  • Plan or membership selection;
  • Referral or invitation information;
  • Consent records;
  • Access status;
  • Dates of registration, activation, or cancellation.

This information may be available to the applicable Studio Creator and authorized Co-Creators.

E. Payment and Transaction Information

When you purchase a subscription, lifetime plan, service, membership, or other paid offering, we or a payment processor may collect:

  • Billing name and contact information;
  • Billing address;
  • Payment-method type;
  • Limited payment-card information, such as card brand and last four digits;
  • Transaction amount;
  • Purchase date;
  • Subscription status;
  • Renewal and cancellation information;
  • Tax and invoice information;
  • Payment failure, dispute, or refund information.

Full payment-card details are generally submitted directly to the payment processor rather than stored by Smartstack.

F. AI Provider and Integration Information

When a Creator connects an AI provider or another integration, we may process:

  • Provider name;
  • API credentials or tokens;
  • Model selections;
  • Integration settings;
  • Connection status;
  • Usage and error information.

Prompts, relevant conversation history, Creator Content, reference documents, and other necessary context may be sent to the selected AI provider to generate a response.

When a Creator uses an independently controlled provider account or API key, the provider’s terms, privacy policy, retention settings, and account configuration may affect how information is processed.

G. Device, Browser, and Usage Information

We may automatically collect:

  • IP address;
  • Browser type;
  • Device type;
  • Operating system;
  • Approximate location derived from IP address;
  • Pages viewed;
  • Links clicked;
  • Referring page;
  • Login activity;
  • Session dates and times;
  • Error logs;
  • Performance information;
  • Feature usage;
  • Studio and Mentor activity;
  • Cookie and similar-technology identifiers.

H. Communications and Support Information

We may collect information when you contact support, send us an email, participate in onboarding, submit feedback, respond to a survey, report abuse or infringement, request a refund, or communicate about a payment or account issue.

I. Information From Other Sources

We may receive information from Studio Creators, Co-Creators, payment processors, authentication providers, AI providers, email providers, referral partners, connected platforms, public sources, and users who invite you to a Studio.

3. Platform Accounts and Creator Studios

Users may first access the Platform through a specific creator, Studio, Mentor, invitation, offer, course, membership, community, or paid plan. When a user creates an account, logs in, joins a Studio, uses a Mentor, or purchases access through AI Mentor Studio, that person is also creating or using an AI Mentor Studio platform account.

This enables one platform identity to access multiple Studios, Mentors, sessions, and creator experiences.

Smartstack may use platform-account information to authenticate users, provide access, maintain security, prevent fraud, troubleshoot issues, provide support, send transactional and product communications, improve onboarding, and develop Platform features.

Studio Creators may separately collect and use information from people who join their Studios, submit forms, purchase plans, or interact with their Mentors. Studio Creators are responsible for their independent privacy notices, marketing practices, follow-up, offers, and legal obligations.

4. Sensitive Information

Mentor conversations may involve personal, financial, health-related, emotional, professional, or other sensitive topics.

AI Mentor Studio is a general-purpose creator platform and is not automatically configured as a regulated healthcare, legal, financial, educational, or clinical system.

Unless Smartstack has expressly entered into a separate written agreement providing otherwise, the Platform is not intended to receive protected health information subject to HIPAA on behalf of a covered entity or business associate.

Do not submit highly sensitive information unless it is genuinely needed, you have the right to provide it, the applicable Studio Creator is authorized to collect it, and appropriate notices, permissions, and safeguards are in place.

Never submit Social Security numbers, complete payment-card numbers, banking passwords, private account credentials, secret API keys, or another person’s highly sensitive information through a Mentor conversation.

5. How We Use Information

We may use personal information to:

  • Create and manage accounts;
  • Authenticate users;
  • Provide Studios, Mentors, pages, memberships, forms, and integrations;
  • Maintain conversation and session progress;
  • Process AI requests;
  • Store Creator Content and User Content;
  • Process payments, renewals, cancellations, refunds, and plan access;
  • Send account, security, billing, product, and support communications;
  • Detect fraud, abuse, spam, unauthorized access, and policy violations;
  • Debug errors and maintain reliability;
  • Understand feature usage and improve the Platform;
  • Develop new features;
  • Comply with law, protect rights, resolve disputes, and enforce agreements.

When practical, we may use aggregated or de-identified information for analytics, research, security, and product development.

6. Artificial Intelligence Processing

To provide AI Mentor responses, the Platform may transmit information to a selected third-party AI provider.

The information transmitted may include:

  • The user’s prompt;
  • Relevant conversation history;
  • Mentor instructions;
  • Studio Creator instructions;
  • Uploaded reference content;
  • Information needed to maintain the Mentor’s flow;
  • Technical and safety information.

AI providers may process this information according to their own agreements, privacy policies, account settings, and data-retention practices.

Studio Creators who connect their own provider accounts are responsible for understanding and appropriately configuring those accounts.

AI Output may be inaccurate. Users should not rely on AI-generated information as the sole basis for important personal, professional, legal, medical, financial, or safety decisions.

7. Lead Capture, Forms, CTAs, and Creator Responsibilities

Creators may collect information from users, leads, clients, members, or audiences through forms, CTAs, Mentor interactions, Studio pages, lead pages, sales pages, or integrations.

Creators are responsible for deciding what to collect, obtaining required consent, providing required notices, using information lawfully, complying with privacy and marketing laws, and configuring external tools and integrations securely.

Smartstack provides the technology tools, but Creators are responsible for their own audience relationships, offers, follow-up, and compliance obligations.

8. How We Disclose Information

A. Studio Creators and Co-Creators

Depending on Platform functionality and permissions, the applicable Studio Creator and authorized Co-Creators may have access to information associated with their Studio, including member names and email addresses, registration information, lead-form submissions, plan and access status, Mentor activity, session or completion information, communications directed to the Studio, and other information intentionally submitted through that Studio.

Studio Creators are responsible for their independent use of this information.

B. Service Providers

We may disclose information to vendors that help us operate the Platform, including cloud-hosting and database providers, authentication providers, AI providers, payment processors, email-delivery providers, analytics providers, customer-support providers, security and fraud-prevention services, domain and infrastructure providers, and professional advisers.

C. Legal, Safety, and Rights Protection

We may disclose information when reasonably necessary to comply with law or legal process, protect a person’s safety or rights, investigate fraud or security issues, enforce our Terms, or establish, exercise, or defend legal claims.

D. Business Transactions

Information may be disclosed or transferred as part of a merger, financing, acquisition, reorganization, bankruptcy, asset sale, or transfer of all or part of the Platform.

E. With Your Direction or Consent

We may disclose information when you direct us to do so, connect an integration, invite another person, publish content, or otherwise consent.

9. Public and Directory Information

Information you intentionally publish on a public Studio page, Mentor listing, lead page, sales page, creator profile, directory listing, or other public area may be viewed, copied, indexed, or shared by others.

Do not publish confidential information or personal information you do not want publicly available.

Removing content from the Platform may not remove copies already saved, indexed, cached, or shared by third parties.

10. Cookies and Similar Technologies

We may use cookies, local storage, pixels, and similar technologies to keep users signed in, remember preferences, maintain security, provide Studio functionality, understand Platform usage, diagnose errors, measure performance, and support marketing or attribution.

Some cookies are necessary for the Platform to operate. Browser settings may allow you to block or delete cookies, but blocking necessary cookies may prevent parts of the Platform from functioning.

Where required, we will provide applicable cookie choices or consent controls. You may review the technologies we use and manage your choices in our Cookie Policy. You can also reopen Cookie Settings at any time through the site’s Cookie Settings control.

11. Sale and Targeted Advertising

We do not currently sell personal information for money.

We do not currently share personal information for cross-context behavioral advertising as that term is defined by California privacy law.

We may use service providers for basic analytics, attribution, communications, and Platform promotion.

If our practices change in a way that creates an applicable opt-out right, we will update this policy and provide the required choice.

Where legally required and applicable to our practices, we will recognize qualifying browser-based opt-out preference signals, such as Global Privacy Control.

12. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information.

No internet transmission, database, cloud service, AI system, or storage method can be guaranteed completely secure.

You are responsible for protecting your password, securing connected API keys, using appropriate access permissions, limiting Co-Creator access, maintaining independent copies of important information, and promptly reporting suspected unauthorized access.

13. Data Retention

We retain information for as long as reasonably necessary to provide the Platform, maintain an account or Studio, preserve Mentor sessions and content, complete transactions, provide support, meet legal and accounting obligations, prevent fraud, resolve disputes, and enforce agreements.

Retention periods vary depending on the information type, account status, Studio Creator actions, legal requirements, and operational needs.

When information is no longer reasonably necessary, we may delete, aggregate, or de-identify it. Information may remain for a limited period in backups, security logs, fraud-prevention records, or records required by law.

14. Account and Content Deletion

Users may be able to delete certain content or close an account through Platform settings or by contacting us.

Deleting an account may not immediately delete information controlled by or shared with a Studio Creator, transaction and tax records, fraud and security records, information required for legal claims, temporary backups, public content copied by third parties, or de-identified and aggregated information.

If information is associated with a particular Studio, we may need to coordinate the request with the applicable Studio Creator.

15. Children and Minors

The Platform is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without legally required authorization.

Account holders, Studio Creators, and paying subscribers must be at least 18.

Creators may not create, publish, market, or operate Mentors or Studios directed primarily to children under 13.

A Creator who designs an experience for teenagers or other minors is responsible for ensuring it is lawful, age-appropriate, properly supervised, and supported by required parental consent, school or organizational approval, privacy safeguards, advertising compliance, and child-safety standards.

Creators may not use AI Mentor Studio to collect personal information from children unlawfully, provide inappropriate, exploitative, manipulative, or unsafe content to minors, or create Mentors that encourage secrecy, dependency, unsafe behavior, or inappropriate relationships between minors and adults.

16. Your Privacy Rights

Depending on where you live and whether an applicable law covers Smartstack’s processing, you may have the right to:

  • Confirm whether we process your personal information;
  • Access personal information we maintain about you;
  • Correct inaccurate information;
  • Request deletion;
  • Obtain a portable copy of certain information;
  • Opt out of certain sales, targeted advertising, sharing, or profiling;
  • Withdraw consent where processing relies on consent;
  • Appeal the denial of a privacy request;
  • Receive equal service without unlawful discrimination for exercising a privacy right.

These rights are subject to legal exceptions and verification requirements.

We may request additional information to verify identity and authority.

Authorized agents may submit requests where permitted by law. We may require proof of authorization and separately verify the request with the individual.

If we deny a request and applicable law provides an appeal right, you may appeal by replying to our decision and stating that you are requesting an appeal.

17. California Privacy Disclosures

California residents may have rights under the California Consumer Privacy Act, as amended, when its requirements apply.

During the preceding 12 months, we may have collected identifiers, customer-record information, commercial information, internet or electronic activity, approximate geolocation, voluntarily submitted audio or visual information, voluntarily provided professional information, inferences based on Platform activity, and sensitive personal information voluntarily submitted through a Mentor or account feature.

We collect and use these categories for the purposes described in this Privacy Policy.

We may disclose these categories to Studio Creators, Co-Creators, service providers, AI providers, payment processors, professional advisers, legal authorities, and transaction participants as described above.

We do not use sensitive personal information to infer characteristics about individuals for unrelated purposes.

We do not knowingly sell or share the personal information of consumers under 16.

California residents may submit applicable requests using the contact information in Section 16.

18. Oregon Privacy Disclosures

Oregon residents may have rights under the Oregon Consumer Privacy Act when its requirements apply, including rights involving confirmation, access, correction, deletion, portability, certain opt-outs, and appeals.

Oregon residents may submit a request or appeal by emailing smartstackplatforms@gmail.com.

We will process verified requests in accordance with applicable law.

19. International Users

Smartstack is based in the United States.

If you access the Platform from another country, your information may be processed and stored in the United States and other countries where our providers operate.

Those countries may have data-protection laws different from the laws in your location.

Where legally required, we will use an appropriate mechanism for international data transfers.

20. Email Communications

We may send account notices, login and verification messages, purchase confirmations, subscription and renewal notices, security alerts, support communications, product updates, educational information, and marketing messages where permitted.

You may unsubscribe from marketing messages using the link in the email. You may continue to receive transactional, security, billing, and service-related communications.

Studio Creators may also send communications to members of their Studios. Questions about those communications should first be directed to the applicable Studio Creator.

21. Third-Party Websites and Services

The Platform may link to or integrate with third-party websites and services.

Their privacy practices are governed by their own policies, not this Privacy Policy.

We encourage you to review the privacy policies of AI providers, payment processors, Studio Creators, and other services you use.

22. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to Platform features, data practices, AI providers, service providers, legal requirements, or business operations.

The revised policy will display an updated effective date.

If a change materially affects how we use personal information, we may provide additional notice through the Platform, dashboard, or email.
